Terms of Service
Last updated: August 26, 2026
1. Who this applies to
These Terms of Service ("Terms") govern use of NextRoute's platform by three kinds of users: restaurants and other merchants who request deliveries, independent drivers who fulfill them, and customers who receive them via a tracking link. By creating an account, accepting a delivery, or using a tracking link, you agree to these Terms.
2. The service
NextRoute is a technology platform that connects merchants with independent, third-party delivery drivers for last-mile delivery. NextRoute is not a delivery company, does not employ drivers, and is not a party to the underlying sale between a merchant and its customer. Drivers are independent contractors, not NextRoute employees or agents.
3. Accounts and eligibility
You must provide accurate registration information and keep your login credentials confidential. You must be at least 18 years old to create a merchant or driver account. Merchants are responsible for the accuracy of business information provided during signup, including legal business name and address.
4. Driver background checks
Driver applicants consent to a background check performed by a third-party consumer reporting agency (currently Checkr, Inc.) as a condition of driving on the platform. Where required by the Fair Credit Reporting Act (FCRA) and applicable state law, NextRoute will provide required disclosures and obtain separate written consent before a check is run, and will follow applicable adverse-action procedures if a check affects a driver's eligibility.
5. Payments and payouts
Payments from merchants and payouts to drivers are processed by Stripe. By using paid features of the platform, you agree to Stripe's terms of service. NextRoute sets delivery pricing (including any platform fee) using rules disclosed in-app at the time of quote; drivers are paid according to the pay calculation shown at the time they accept a delivery. NextRoute does not custody funds outside of Stripe's infrastructure.
6. Location and tracking data
Driver location is collected while a driver is online or has an active delivery, and is shared with the relevant merchant and customer for that delivery via a tracking link. Customers may share tracking links; anyone with a valid link can view delivery status for that order.
7. Prohibited conduct
You may not use the platform to violate any law, misrepresent your identity or business, circumvent background-check requirements, harass other users, or interfere with the platform's operation.
8. Disclaimers and limitation of liability
The platform is provided "as is." To the maximum extent permitted by law, NextRoute disclaims warranties of any kind and is not liable for indirect, incidental, or consequential damages arising from use of the platform, including delivery delays, food quality, or driver conduct, except where such liability cannot be limited by law.
9. Termination
NextRoute may suspend or terminate any account for violation of these Terms, failed or disqualifying background-check results (for drivers), or fraudulent activity.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.
